Please read these Terms & Conditions carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms & Conditions please do not use the website www.byfordsfoodhall.co.uk

 

The site www.byfordsfoodhall.co.uk is provided to you free of charge subject to these Terms & Conditions and our Privacy Policy. By using this site you are agreeing to these Terms & Conditions and Privacy Policy.

 

1. Prices

Please note that the prices on our website are guide prices only. The actual price you pay will be the price charged in store at the time your order is picked for delivery. The actual order value cannot be determined until the day of delivery because the prices stated on the website may vary either above or below the prices in store on the day your order is picked and delivered.

All prices are expressed inclusive of any VAT payable unless otherwise stated. On 1 January the Government will be increasing the rate of VAT from 15% to 17.5%. This will affect the price of some grocery products including food, health and beauty and household goods such as detergents and cleaners. This increase will be reflectedin all orders delivered from 1st January onwards including orders that have been placed prior to the 1st January but for delivery on or after this date. The price of the items does not include the service charge which will be charged at the rates applicable at the date of your order and which will be displayed in the 'Place an order' section of the website.

When your order is delivered you may return any item and receive a full refund if you consider that the difference between the price charged and the guide price shown on the item is unacceptable.

2. Availability

If for any reason beyond our reasonable control, we are unable to supply a particular item, we will note be liable to you. Please note that we will attempt to deliver substitute lines should the selected lines be unavailable unless you request us not to do so. Should you be dissatisfied with any item substitute item please see 5. Returns. If you are unable to return the item to the shop premises we will arrange to collect it at no cost to you.

3. Acceptance

There will be no contract of any kind between you and us until we take payment by credit/debit card over the phone from you, or until we actually dispatch the goods to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually receive payment by credit/debitc card over the phone or until we dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are paid for by debit/credit card over the phone or dispatched (and not before then), a contract will be made between you and us, and you will be charged for the goods.

4. Delivery

Delivery will be made to the address specified by you in your e-mail. Delivery Charges apply and do vary according to the type of order, e.g. grocery or catering, and the distance between the shop premises and the delivery address.

We will deliver your order to the main entrance of the delivery address. At your request, our driver may carry your order into the delivery address, for example, to a particular floor in an apartment block or into your kitchen but only if: a. the driver has your permission and b. our driver believes that it is safe and practical to do as you request. We always reserve the right to deliver only to the main entrance of the delivery address.

Please note that there may be regions that we are unable to deliver to. Please Contact Us if you are unsure.

Delivery times will be agreed with you at the time of placing your order.

All goods must be signed for on delivery by an adult aged 18 years or over. Byfords follows a "Think 25" policy, so if the person receiving the goods looks under 25, proof of age will be requested. If proof is not available and there is no-one of that age at the address when delivery is being made, the goods may be retained by the driver. If we attempt to deliver your order to the delivery address as arranged with you but there is nobody at the delivery address to accept your order, the driver will leave notification of attempted delivery and you will need to Contact Us to re-arrange delivery.

In these circumstances, if we have to return to deliver the goods, a further charge may become payable provided that delivery is attempted at the agreed time.

Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.

5. Returns

We hope you will be happy with your purchase. However, should you feel it necessary to return an item, we aim to make the returns process as simple as possible.

Non-perishable items

If you are unhappy with any non-perishable items, simply return them to us, in the original packaging within 14 days of dispatch and we will give you a refund on those products or replace the item. If you are unable to return the item to the shop premises we will arrange to collect it at no cost to you.

Perishable items

If you are unhappy with any perishable item you must notify us within 24 hours of delivery on 01702 525903 and we will arrange for an immediate collection and refund or replacement as requested. Any item to be returned must remain in its original packaging and kept refridgerated.

6. Cancellation

Catering Orders

You have the right to cancel the contract from the date the order was placed up until 10 days before delivery and up to seven working days after delivery, beginning the day after delivery. You do not have a right to cancel perishable goods.

Grocery Orders

You have the right to cancel the contract from the date the order was placed and up to seven working days after delivery, beginning the day after delivery. You do not have a right to cancel perishable goods.

Exercising your rights of cancellation

To exercise your right of cancellation, you must provide us with written notice. You must do this by giving details of the goods ordered and (where appropriate) their delivery.

You must write to us at Byfords Food Hall Ltd, 114-118 Eastwood Old Road, Leigh-on-Sea, SS9 4RY; or email us at info@byfordsfoodhall.co.uk.

Once you have notified us that you are cancelling the contract, you must return the goods to us at Byfords Food Hall Ltd, 114-118 Eastwood Old Road, Leigh-on-Sea, SS9 4RY at your own expense. You are advised to send the goods by recorded delivery or other traceable means. A collection may be arranged but charges will apply.

Once you have notified us that you are cancelling the contract, we will refund or re-credit you as soon as possible but in any event, within 30 days, for any sum that has been paid by you for the goods excluding any extra charges incurred by us at your request (e.g. Express delivery costs).

You have a duty of care, under these terms, to take care of the goods so tha they may be sold again as new. All tags and labels should still be attached - we strongly advise you to check the items carefully before removing any tags and labels. We will claim, from you, for the resulting loss in value for goods not kept so they may be sold again as new.

7. Payment

You can pay by cash, cheque with cheque guarentee card or credit card (Visa, Visa Electron, Mastercard, Maestro, Delta). We do not currently accept American Express cards. Authority for payment is only required when paying by credit/debit card over the telephone.

Our liability to you in connection with any order will not exceed the total price charged for the relevant items.

8. General

These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whoe or in part, this will not affect the avlidity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

10. Mobile Phone Top-Up Vouchers Terms & Conditions

Problems activating the PIN code

If you have an issue activating your PIN code you should contact your mobile phone operator. If the issue relates to your email or order, please call us on 01702 525903.

Orders containing only a Mobile Phone Top-Up Voucher

For orders containing only mobile phone top-up vouchers, you will not receive a delivery from a Dotcom van. Normal delivery charges will still apply.

Refunds

If you purchase a mobile phone top-up voucher, you can change your mind and cancel the voucher within 14 days of dispatch and we will give you a refund. To cancel please e-mail us at info@byfordsfoodhall.co.uk However, your right to cancel the voucher ends as soon as it is activated.
